The operator

Which legal entity operates the service

Bayan Capital is a trading name used by the company that owns and operates this website and the associated client platform.

The operating company is the entity you contract with when you accept our Terms of Use and establish an account. The complete legal designation, corporate structure, registration details and group affiliation are outlined in the client agreement provided during onboarding, and are made available upon request via the methods outlined in the "Obtaining documentation" section below.

Because corporate structures, registered particulars and service arrangements can change, we deliberately do not restate them as fixed text on a marketing page. The client agreement and the documentation pack we send you are the authoritative source; where this page and those documents differ, the documents prevail.

Group companies and service providers

Certain functions - technology hosting, payment processing, market data, customer identification tools - are carried out by specialist third-party providers under written agreements. The categories of provider we use, and the way your personal data is handled by them, are described in our Privacy Policy. We do not publish provider names on this page.

Framework

The regulatory framework we work within

We describe here the type of obligations that govern the service, rather than naming authorities or quoting reference numbers, which belong in the formal documentation.

  1. 01

    Client identification

Every account is verified before funding, trading or withdrawal, in line with the KYC and AML controls described on our KYC & AML page.

  2. 02

    Financial-crime prevention

Implementation of sanctions and risk assessment protocols, continuous monitoring of transactions, internal escalation mechanisms and maintenance of records for periods mandated by governing regulations.

  3. 03

    Handling of client money

Client funds are held in segregated accounts distinct from company operational capital, with withdrawals directed to a registered account held in the client's name only.

  4. 04

    Fair and clear communication

Costs, spreads and any applicable fees are published in your account and on our pricing page. We do not promise specific returns, and all promotional material carries a risk warning.

  5. 05

    Data protection

Personal information is managed according to a specified lawful basis, stored for no longer than required, and safeguarded through authentication protocols and data encryption both during transmission and storage.

  6. 06

    Complaints handling

A documented internal dispute resolution process that includes receipt confirmation, thorough assessment and a detailed response provided within the timeframe communicated upon filing your dispute.

Should a territory enforce more stringent local rules than specified herein, those more stringent obligations shall apply to clients domiciled in such territory.

Availability

Jurisdictions served and excluded

The service is offered only where we are permitted to offer it. Availability is assessed at registration on the basis of your country of residence, and it can change.

Where the service is offered

Account registration is available to inhabitants of nations designated as permissible in the account signup process. Should your nation appear on this list and you successfully complete validation, you may continue. Should it not appear, you are unable to access this service.

Where the service is not offered

  • Nations and regions subject to relevant international sanctions regimes or trade restrictions.
  • Regions where providing this service category to non-professional clients demands a regional licensing mandate that we have not obtained.
  • Regions assessed as presenting elevated financial crime vulnerability pursuant to relevant standards.
  • Any geographic area we have opted to restrict based on our own internal compliance assessments.

No solicitation

Nothing on this website is directed at, or intended for distribution to or use by, any person in a jurisdiction where such distribution or use would be contrary to local law. Accessing this site from an excluded jurisdiction does not create a right to use the service. If you move to an excluded jurisdiction while holding an account, tell us - the account may need to be restricted or closed and any balance returned to you.

Documentation

How to obtain corporate and compliance materials

Clients, prospective clients and professional counterparties may request our corporate and compliance documentation. We provide it on request rather than publishing it openly.

What can be requested

  • Verification of the authorized operator and its registered details.
  • The current client agreement and the schedule of costs applicable to your account.
  • A summary of our AML and client-identification procedures.
  • The complaints-handling procedure and escalation route.
  • Data-protection information relating to your own personal data.

How to make the request

  1. 01

    Write to us

Use the contact route on our contact page. Put "Regulatory documentation request" in the subject line.

  2. 02

    Identify yourself

State whether you are an existing client (and give the email address on the account) or a prospective client, and which documents you need.

  3. 03

    Receive the pack

Requests are answered within the timeframe stated when your request is acknowledged. Some documents may be provided in extract form where they contain confidential internal detail.

Documents are sent to the verified contact details on file. We cannot send account-specific documentation to a third party without your written authorisation.

Contact

Regulatory and compliance questions

Questions about our regulatory position, our compliance procedures, or a concern you would like escalated should go to the compliance route rather than to general support.

How do I raise a compliance question?

Send it through the contact page and mark it "Compliance". Include the account email address if you already hold an account, and describe the question in a sentence or two.

How do I make a formal complaint?

Submit via the same channel and label your message "Dispute". You will be provided with a receipt, case reference and estimated response duration. Should the resolution not address your concern, the response will outline the additional escalation channels accessible to you.

What is the procedure for reporting unlawful conduct or misuse of our identity?

Submit through the abuse reporting interface. Fraudulent use of Bayan Capital in communications, promotional material or unauthorized replications should be communicated there to facilitate our intervention.

Are institutional or press enquiries handled here?

Absolutely - transmit them via the messaging portal with a descriptive heading and the appropriate department will handle them.
